Welcome to LàSTATE. These Terms of Service govern your use of the LàSTATE website and your purchase of products from us.
By accessing our website or placing an order, you agree to these Terms of Service, together with our Return & Refund Policy, Privacy Policy and other applicable store policies.
These Terms are subject to applicable South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
1. About LàSTATE
LàSTATE is a fashion and streetwear brand offering clothing and related products through its online store.
References to “LàSTATE”, “we”, “us” or “our” mean LàSTATE.
References to “you” or “customer” mean any person who uses our website or purchases our products.
2. Use of Our Website
You agree to use the LàSTATE website lawfully and responsibly.
You may not:
- Use the website for unlawful or fraudulent purposes.
- Attempt to interfere with or damage the website.
- Attempt to gain unauthorised access to our systems.
- Copy, reproduce or commercially exploit our website content without permission.

3. Products and Product Information

However, colours may appear differently depending on your device or screen.
Minor variations in manufacturing, printing, colour or finishing may occur and do not necessarily constitute a defect.
Nothing in this section limits your statutory rights where goods are defective, unsafe, not as described or otherwise fail to comply with applicable law.
4. Prices
All prices displayed on the website will be stated in South African Rand (ZAR), unless otherwise indicated.
Prices may change from time to time.
Any price change will not affect an order that has already been accepted, except where permitted by applicable law.
We will make reasonable efforts to ensure that pricing errors are identified and corrected.
5. Orders
When you place an order, you are making an offer to purchase the selected products.
An order is subject to availability and confirmation.
We may contact you if additional information is required to process your order.
If we are unable to fulfil an order because the product is unavailable, we will notify you and provide the applicable remedy in accordance with South African law.
6. Payment
Payment must be successfully completed through the payment methods made available at checkout.
You agree to provide accurate payment and billing information.
We do not knowingly store complete payment-card information where this is handled securely by our payment service provider.
If a payment is reversed, disputed or identified as fraudulent, we may investigate the transaction and take reasonable steps permitted by law.
7. Delivery
We will deliver orders to the delivery address provided during checkout.
Delivery times will be communicated on the website or during checkout where applicable.
Where a specific delivery period has been agreed, we will make reasonable efforts to meet it.
If an order cannot be fulfilled within the agreed period, your rights will be determined in accordance with applicable law.
For electronic transactions, ECTA contains specific rules regarding fulfilment of orders and delays.
Once an order has been delivered to the address supplied by the customer, the customer is responsible for ensuring that the delivery information provided to LàSTATE was accurate.
8. Returns, Refunds and Exchanges
Returns, refunds and exchanges are governed by our Return & Refund Policy.
Nothing in that policy or these Terms removes or limits rights granted to consumers by applicable South African law.
Where the CPA or ECTA provides a consumer with a right to cancel, return or obtain a remedy, that right will apply notwithstanding any voluntary store policy.
9. Defective Products
Nothing in these Terms excludes or limits the statutory protections applicable to defective or unsafe products.
Where the CPA applies, consumers retain their applicable statutory rights relating to the quality, safety and durability of goods.
Our Return & Refund Policy explains the process for reporting and returning defective products.
10. Intellectual Property
All LàSTATE branding, logos, names, graphics, photographs, designs, artwork, product imagery, text and other original content displayed on the website belong to LàSTATE or are used with permission.
You may not reproduce, modify, distribute, sell, copy or commercially exploit our intellectual property without our prior written permission.
Purchasing a LàSTATE product does not transfer ownership of LàSTATE's intellectual-property rights to the customer.
11. User-Submitted Content
If you voluntarily submit photographs, reviews, comments or other content to LàSTATE, you confirm that you have the right to provide that content.
You must not submit content that is unlawful, defamatory, infringing, abusive or otherwise harmful.
Where you submit content for publication, you grant LàSTATE permission to use it for legitimate brand and marketing purposes to the extent permitted by applicable law.
12. Promotions and Discount Codes
Promotional offers and discount codes may have additional terms.
Unless otherwise stated:
- Discount codes cannot be exchanged for cash.
- Only one promotional code may be used per order.
- Promotions are subject to availability.
- LàSTATE may withdraw or modify a promotion where reasonably necessary, subject to applicable law.
Promotional terms will not remove statutory consumer rights.
13. Gift Cards
Gift cards, where offered, are subject to the specific terms displayed when the gift card is purchased.
Gift cards may not be exchanged for cash unless required by applicable law.
Gift-card terms, expiry periods and redemption conditions will be communicated before purchase.
14. Website Availability
We aim to keep the website available and functioning properly but cannot guarantee uninterrupted access at all times.
The website may occasionally be unavailable because of maintenance, technical problems, updates or circumstances outside our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.

To the extent permitted by law, LàSTATE will not be responsible for losses arising solely from circumstances outside our reasonable control.
We will not use this section to avoid responsibility for our own unlawful conduct, defective goods or statutory obligations.
18. Events Outside Our Reasonable Control
LàSTATE will not be responsible for delays caused by circumstances reasonably outside our control, such as natural disasters, serious network failures, strikes, civil disturbances, government restrictions or major disruptions to delivery services.
Where such an event affects an order, we will take reasonable steps to notify affected customers and provide any remedy required by law.
19. Changes to These Terms
We may update these Terms from time to time.
The latest version will be published on our website with the applicable effective date.
Changes will not retrospectively remove rights that consumers have already acquired under applicable law.
20. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Nothing in these Terms prevents a consumer from exercising any right or remedy available under applicable South African consumer-protection legislation.

If you have a complaint about an order, product or service, please contact LàSTATE through our official customer-service channel.
We will make reasonable efforts to investigate and resolve complaints fairly and promptly.
22. Statutory Rights
Nothing in these Terms is intended to exclude, restrict, waive or limit any right or remedy that a consumer has under applicable law.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or removed to the extent necessary, while the remaining provisions will continue to apply.
LàSTATE reserves the right to update these Terms when necessary to reflect changes in our business or applicable legislation.
